The Incorrigible Senator-Judge

Robin Padilla spent the week teaching a lead prosecutor how prosecution works. The problem was that his lesson was wrong. He called on the prosecution not to be “one-sided” during Vice President Sara Duterte’s impeachment trial.

It was as if he were saying the prosecution was wrong for doing its job, which is to prosecute. Batangas Rep. Gerville Luistro, given the unenviable task of explaining civics to a supposedly impartial judge, obliged with the patience of a home-school teacher. Bias is expected in an adversarial trial, she pointed out, and it would be more surprising if the prosecution were neutral or defended the respondent. On its face, it was not a controversial point. It was the point.

Padilla did not so much accept the correction as absorb it. He reissued it as a grievance in a Facebook rejoinder, reminding the prosecution that its role “is not to win, but to pursue the truth and protect the innocent,” and that the defense exists “to safeguard human rights and ensure a balance of power.” All week, he has regurgitated a non sequitur with the confidence of someone who believes repetition is a form of proof.

What makes this worth an editorial rather than a news brief is not the argument, which collapses upon contact with a first-year law student. It is the spectacle of a senator-judge who evidently believes that being told by the whole world that he is wrong is an invitation to issue a longer statement, not a reason to stop.

The satire writes itself. The Senate’s top vote-getter tried to relitigate the difference between “prosecutor” and “judge” with a sitting member of the House who has almost certainly read the Rules of Court. Imagine a B-movie in which Padilla, undeterred, enters again in the next scene. The correction lands, the audience reacts, and Escudero gavels for order. Padilla returns the next morning with a fresh paragraph making the same request in gentler Tagalog.

Whether this is strategy or instinct is the more interesting question. He is, after all, a senator whose national brand was built on being unmanageable in exactly this way. He is a popular action star who does not read the room, and he has been rewarded for it before. It would not be the first time the country watched him walk into a wall and emerge on the other side more popular than when he went in.

Whether the impeachment court extends him the same grace remains to be seen. Perhaps somewhere in the next episode, his incorrigibility will cease to be charming and become disqualifying. Even Padilla may be working that out in real time.
