CSC revs up City Hall power play, rejects Bayron appointees

The City government confirmed on Tuesday it has received a memorandum from the Civil Service Commission (CSC) turning down the appointment of 41 city department officials by Mayor Lucilo Bayron because of the Ombudsman’s dismissal order against the latter.

City legal officer Arnel Pedrosa said they are questioning the validity of the CSC order, insisting that Bayron’s current occupation of the mayoralty post is legal, and so was the appointments he had made, based on the latest ruling of the Court of Appeals which dismissed the complaint against him for dishonesty and grave abuse of authority.

Pedrosa expressed frustration that the CSC memo even went to the extent of disqualifying the 41 appointed officials from holding any other public office.

“Binabanggit dun na ‘yung lahat ng appointees daw ay dismissed and convicted of a crime. Merong naka-attached na perpetual disqualification to hold public office,” Pedrosa said. He pointed out that the appointees concerned had not been convicted of any crime nor had prior dismissal from service.

“Hindi naman totoo ‘yun. Lahat ba ng 41 appointees na ito ay may kaso? Or lahat ba sila eh na-convict na with a crime or dismissal from their service at hindi mo na puwede i-rehire as government employee? It is wrong,” Pedrosa said.

Pedrosa maintained that Bayron is an incumbent official and that he has the right to exercise his rights and duties as mayor, including the power appoint a public servant as he deems fit.

“Wala na raw kapangyarihan si Mayor Bayron to issue appointments which is wrong kasi si mayor pa din ang mayor ng Puerto Princesa. At dahil diyan, meron siyang kapangyarihan to continue and discharge his duties and functions as mayor which includes the power to appoint and hire public officers and employees of the government,” Pedrosa said.

Pedrosa admitted they were surprised by the CSC memorandum even as he broadly insinuated this may have been a handiwork of their political opponents.

“Nagtataka nga ako may mga advance information agad itong mga nasa kabila. Hindi nga natin alam. Nasorpresa din tayo.  Ang problema lang, ang pinagdidiskitahan nila hindi naman si Mayor Bayron talaga kundi ‘yung mga inappoint niya. Unfair din sa mga empleyadong ito na qualified naman i-promote, qualified naman na i-appoint pero bakit hinahadlangan nilla dahil lang sa gusto nilang manggulo sa pamumuno ni mayor,” Pedorsa said.
