The Areza Cruz Realty and Development Company Inc. (ACRDCI) has been given 10 days by the city government to turn over the management of the public markets, citing a recent ruling issued in its favor by the Court of Appeals (CA).
Atty. Arnel Pedrosa, City Legal Officer, informed Palawan News on Wednesday that they have issued Areza, through its President, Cesar B. Areza, a formal notice to vacate the premises by July 9, 2018.
He stated they intend to take over the management of both the old and new markets, including the slaughterhouse, even without a court order.
“HIndi na kailangan ng court order kasi executory na siya. Ang decision ng CA ay void ab initio (from the beginning) ‘yong agreement. We will take over with the help of the PNP,” he said.
He stressed that the take over will happen by virtue of the ruling of the 11th Division of the CA issued on May 30, 2018.
A portion of the notice to vacate reads: “In view of Section 4, Rule 39 of the Rules of Court, we are giving you 10 days from receipt of this notice to voluntarily vacate and peacefully turn-over the management of the old and new public market and the slaughterhouse to the City Government of Puerto Princesa.”
The CA ruled the city government has the power over the public markets and the slaughterhouse currently being managed by Areza-Cruz under a privatization agreement that was forged with the previous administration.
It involved a case filed in 2016 by the city government to get back the authority to manage the facilities.
He criticized Areza-Cruz’ poor maintenance of the public markets, particularly the cleanliness and sanitation of the toilets.
“Kung hindi natin ita-take over ay dudumi at dudumi lang. Walang maintenance at ang dumi pa ng mga CR. Total masyadong kumikita na sila, dapat e-peacefully turnover na nila sa amin,” he said.
He added they expect a peaceful turnover from Areza-Cruz due to the decision of the CA.
